1) Acceptance of terms

By accessing or using FitPocket, you agree to be bound by these Terms of Service and our Privacy Policy.

2) Service description and wellness boundary

FitPocket is a consumer wellness platform. It is not a medical device, healthcare provider, diagnosis tool, or substitute for professional medical advice. FitPocket may provide fitness, nutrition, habit, and wellness-related information, but this information is for general wellness purposes only and should not be treated as medical advice.

3) Accounts and user responsibility

• You are responsible for maintaining the confidentiality of your account.
• You must be 16+ or have consent where required by law.
• You agree to provide accurate, current, and complete information.
• You are responsible for using judgement before acting on fitness, nutrition, habit, or wellness guidance.
• You should stop activity and seek appropriate professional help if you experience pain, injury symptoms, medical concerns, or unusual discomfort.
• You should consult a qualified professional before making major health, nutrition, exercise, or lifestyle changes where appropriate.

4) Billing and subscriptions

• Payments for FitPocket may be processed through Apple App Store or Google Play depending on the platform used.
• Subscription management, renewals, cancellations, refunds, and payment method changes are handled through the user’s app-store account where applicable and the app store’s applicable terms.
• FitPocket may use app-store-provided subscription status information to determine access to paid features.
• Some features are available only on paid tiers; see Pricing.
• Subscription access may remain active until the end of the applicable billing period unless the applicable app store or applicable law provides otherwise.

5) Acceptable use

• No unlawful, misleading, abusive, or harmful activity.
• No scraping, reverse engineering, interference with security controls, or misuse of APIs.
• No unauthorized commercial exploitation.
• Customers or partners may not use FitPocket for HIPAA-regulated workflows, clinical patient management, employer health surveillance, or similar regulated use cases unless FitPocket has expressly agreed to that use in writing.

6) HIPAA-regulated workflows

FitPocket is not intended to be used by covered entities or business associates to create, receive, maintain, or transmit HIPAA-regulated protected health information unless a separate Business Associate Agreement has been executed by FitPocket.

7) AI-powered features

AI-generated outputs may be incomplete, inaccurate, outdated, or unsuitable for a user’s specific circumstances. Users are responsible for applying judgement and seeking qualified professional advice where appropriate.

8) Emergency and medical conditions

FitPocket is not intended for emergencies, diagnosis, treatment, or management of medical conditions. Users should seek professional medical help for medical issues, emergencies, injuries, symptoms, or health concerns.

9) Content and IP

• FitPocket materials are owned by FitPocket or its licensors.
• You retain rights to your uploaded photos, measurements, prompts, notes, and other user content.
• You grant FitPocket a limited license to process your content to provide, secure, maintain, personalise, and improve the service.

10) Privacy, security, and trust

FitPocket uses privacy-first controls and technical and organisational safeguards designed to protect personal information. More information is available in our Trust Center. Our Trust Center describes SOC 2 readiness and privacy principles; it does not state or imply compliance certification.

11) Disclaimers

The service is provided “as is.” We disclaim warranties to the fullest extent permitted by law. Fitness, nutrition, habit, and wellness outcomes vary.

12) Limitation of liability

To the maximum extent permitted by law, FitPocket shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

13) Termination

We may suspend or terminate access if you breach these terms. You may stop using the service at any time.

14) Changes to terms

We may update these terms; continued use constitutes acceptance of changes.
